TIVERTON YACHT CLUB INC. MARINA OPERATIONS

General Policy For Marina Operations:

As adopted by TYC board of directors on June 25,1990. and amended on January 14,1991 and March 11,2003.

The general policy and conditions for Marina Operations will be established using the following as a set of basic guidelines. The rules and policies do not attempt to legislate every possible circumstance that will arise in the management and use of this facility. They do however, reflect the overall intentions/spirit and principles of the TYC for the use and management of these facilities.

The Marina chairman has the right to bring any circumstances and/or conditions that he/she believes are in violation of this basic policy before the Marina Committee. The recommendations of the committee will then be presented to the board of directors of the TYC for their decision. The member has the right to petition the board of directors in his/her behalf.

A. The TYC slips/moorings are intended for the private non-commercial use of its members.

B. It is expected that members renting slips/moorings have a boat to place at these facilities.

C. Some rules and policies have been made to explicitly encourage active participation in the TYC.

RULES/POLICIES

1. Three separate waiting lists will be established – one for slips. one for moorings. and one for dinghy docks. These lists will be used to assign slips and moorings as they become available. A member must notify the Marina chairman In writing and include payment of a one time fee of $20.00 to have his/her name placed on either or both of these lists. Position on both lists will be determined by a point system described below. These lists will be posted in the TYC clubhouse. No member may join the slip, mooring or dinghy dock waiting list and obtain a dock , mooring or dinghy space for one year from the date of application to the list, regardless of seniority, unless they are the only one on the list. After one vear the member’s seniority will apply and they will be moved to the appropriate position on the list.

2. Members who have been notified that a slip/mooring is available must respond within five (5) days of notification.

3. Point system :

1 point for each year of active membership. (years while on LOA or RES will not be counted)

3 additional points for each year on board of directors.

2 additional points for each year as committee chair.

1 additional point for year of participation on any committee. (2 points max per membership)

The initial list will be established using 1987 as a base year for calculation of additional points. The base year for membership points will be 1974.

A maximum of four (4) points per year, per membership, can be obtained by any member, this includes the one-point given for active membership.

In January of every year the chairperson of each committee will present a list of all members on their committee, with points earned. This list, after approval by the board of directors, will be used to recalculate positions on slip and mooring waiting lists for the next season.

4, Starting with the 1991 season, all current slip/mooring holders will be required to earn one (1) extra point per year. Members can earn a point thru active participation in club activities. (work parties, committee membership, etc.) Members who have not earned an extra point will be subject to lease cancellation. All Slip holders or their representative are required to participate in putting the floats into service in the spring and their removal in the fall. All Slip and mooring holders are automatically members of the Marina Committee and are encouraged to attend all called meetings of that committee.

5. When slips/moorings become available the member with highest number of points and on slip/mooring waiting lists will be given first choice of slip or mooring spaces. All attempts to adjust for boat size will be made. However, if boat is just too large or to small to fit in available space the next person on the list will be considered. In case of equal points where more than one member is eligible for the available slip, the tie will be broken by...

A. Total Years of Active Membership.

B. Length of time on Slip/Mooring Waiting List.

C. A random method determined by all parties involved and present at time the selection is made. (coin flip, drawing, etc.)

6. A one-year, one-time refusal of a lease for a slip or mooring can be granted by the TYC Marina Chairman, for that year only the available slip will be sub-leased by the TYC. A $100.00 charge for a slip and a $50.00 charge for a mooring will be assessed to the member. If the TYC can not sub-lease the space the member must pay-in-full. In any case, a member who has been granted a sub-lease forfeits all rights to use his/her slip/mooring for the season. The TYC can use this slip for whatever purpose it chooses. ‘"

7. All boats must be registered in the member’s name who is using the slip/mooring. The name on the registration must be associated directly to a name on the club’s membership list. Boats owned by corporations or in partnerships may be subject to special approval by the board of directors. Boats leased or chartered by members are permitted and may use the member’s current slip/mooring. However, the member who has chartered/leased the boat must be the primary user.

8. Any member who is currently leasing a slip and has purchased a larger boat that will not fit into his/her current location will be moved to the head of the slip waiting list and will be offered the first new slip of appropriate size to become available. Their old slip will be apportioned to the next-in-line on the waiting list who own a vessel of appropriate size for that slip. Current slip holders who have notified the Marina Chairman that they would like a larger slip, and if one becomes available, after satisfying the above noted apportionment, they will be moved to that position, as they have already passed the Waiting List requirements by possessing a slip.

9. All members leasing a slip/mooring must provide the Marina Committee Chair with a photocopy of their insurance policy, which must have a minimum amount of liability coverage of $25,000.00. The leasee will also be required to to sign a lease agreement which states. "I do hereby release the Tiverton Yacht Club and any or all of its officers, members and employees from any liability and or damage claims that may accrue in my favor against them growing out of, or as a result of this assignment and occupancy and use of any slip, dock, float or facility provided: I assume all risk of injury and damage to a person and property, whether caused by negligence or otherwise. " The completed lease form and insurance certificate copy must be presented to the Marina Committee prior to the vessels use of the facilities.

10. There will be no penalty for refusing a slip.

11. Members who have resigned from the club and then subsequently retum will be placed back on

the priority list In accordance with their total points at the time of their return. No points will be added to

members total points for years while on leave of absence or resignation.

12. For purpose of the slip/mooring priority list, junior members who become full members will start at the bottom of priority list and start accumulating points starting with the year they became full members.

13. No commercial use can be made of any slip or mooring. (sales, chartering, etc.)

14. Members can not sub-lease slips/moorings. Only boats fisted on signed lease agreements can

occupy assigned spaces.

15. A return to basin waiting Iist will be established for members who have leased moorings

located outside of the basin. The priority of this list will be determined using the length of time spent outside the basin. The member having spent longest time outside the basin will be the next to return.

16. Dinghies on the dinghy dock may not exceed 10ft. In length nor have a motor larger than 15HP. A dinghy is classified as a vessel used to transport personnel from the mother ship to the dock. Thus,

small recreational vessels are not to be stored at the dinghy dock. Standing racks on the beach are available for dinghies other than dinghies used by members on moorings or members who are in club slips.

17. Any member who violates any of the terms and/or conditions of the signed lease agreement is subject to lease cancellation.

Dinghy and Small Boat Special Regulations 2003

Small boat storage at the TYC marina is difficult, due to lack of space and the large number of boats being stored. The Marina Committee has posted the Marina Rules in the clubhouse and on the club Web site, and asks all members to read and be familiar with these rules. Several regulations that are important are those for the dinghy dock and the dry storage racks listed below. Please help all of us by following these rules as they help all members who use these facilities. The club stewards will be monitoring and enforcing the club marina rules on a daily basis to insure the smooth running and safety of our facilities.

Dinghy Dock- All boats stored at the dinghy dock must have a valid club sticker with assigned location number. Your boat must be in it’s assigned location at all times. Please do not use painters or lock lines shorter than 3 ft. as this makes it difficult for neighboring dingy owners to maneuver their boat alongside the dock. The clubs stewards will make daily checks to verify locations. If you are a first-time offender you will be given 24-hour notice to move the boat. If the boat is not moved a $25.00 fine will be issued and the boat will be moved from the marina. A second offense will be fined $50.00 and the boat removed immediately, a third offense will be fined $ 100.00 and the boat will not be allowed back into the marina for the season. TYC will not be responsible for damage to locking devices as a result of removing a small boat from the marina. It should be noted that dinghy dock locations W1 thru W6 are for non-inflatable dinghies so the slips west of the dock have room to leave and enter their berths. .

No boats or dinghies may be stored on top of any docks in the marina, including the dinghv docks. Offenders will incur fines and penalties as noted above.

Dry Storage Racks I Beach Storage - No beach storage is allowed except for the boats used in the Junior Program. All personal boats must be kept in their assigned storage racks. The club will provide one set of wheel dollies to move boats from the storage racks to the water. Please remember to return the dollies to the top of the beach area, as they can float away should they be left at the low-tide line. Personal dollies other than those permanently attach to the boat are not allowed on the beach at any time.

Boats stored on trailers are not allowed on the beach at any time.
